1. Part A. Using this website

What the site is. The site describes Elevates and our services. Articles are general information, not advice for your situation. We can change or remove content at any time.

Our content. The text, design, graphics, logos and code on this site belong to Elevates or to those who licensed them to us. You may read, print and share links to our pages, and quote short passages with a link to the source. Anything more needs our written permission.

What you may not do. Do not try to gain access to systems you are not authorised to use, interfere with the site, upload malicious code, or misuse the contact form, the booking tool or our email addresses.

Other websites. Links to other websites are for convenience. We do not control those sites and are not responsible for them.

Our liability for the website. The site is provided as it is. To the extent the law allows, we are not liable for loss arising from using the site or from being unable to use it. Section C1 applies.

  2. Part B. Our services

Who our services are for. Our services are for businesses. If you are a consumer, tell us before we agree anything, so that we can give you the information and rights that consumer law requires, including any right to withdraw from a contract made at a distance.

What we do. We build web applications, give strategic digital consultancy, and improve websites using data.

A signed agreement comes first. When you and we sign an agreement for a project, including a memorandum of agreement, work order or statement of work, that agreement governs the project in full: scope, fees, payment, intellectual property, liability, governing law, courts and everything else it covers. These terms apply only to matters the signed agreement does not address, and never override it.

Quotes and free conversations. A quote binds neither of us until it is signed. Free calls, reviews and audits are general guidance. Our total liability for anything we provide free of charge is limited to one hundred euros (€100), subject to section C1.

Intellectual property, where no signed agreement says otherwise. We keep ownership of what we create, including our tools, code libraries and methods. Once we receive full payment for a deliverable, you receive a perpetual, irrevocable, worldwide licence, which is not exclusive, to use, display and operate that deliverable for your own business.

Your materials. You confirm that you have the rights to the text, images, data and other material you give us. If someone claims that our use of your material, as you instructed, infringes their rights, you will cover our reasonable costs of that claim.

Our liability for services, where no signed agreement says otherwise. Our total liability is limited to the fees you paid or were invoiced in the 12 months before the event that caused the claim. We are not liable for indirect loss, such as lost profit, lost data or lost opportunity. Section C1 applies.

Events outside our control. Neither of us is liable for delay or failure caused by events outside reasonable control, such as natural disasters, epidemics, attacks on or failures of infrastructure, government action or war. The affected party tells the other promptly and limits the effects as far as it reasonably can. If the event lasts more than 60 consecutive days, either of us may end the affected work by written notice, and fees already earned remain due.

Services from other providers. Some of our work relies on other providers, such as hosting, email, analytics or payment services. Their own terms apply to their services, and a link to another provider does not mean we endorse it.

  3. Part C. General

What we cannot limit. Nothing in these terms limits liability for intentional breach, or any other liability that Estonian law does not allow to be limited.

Law and courts. Estonian law governs these terms. Disputes go to Harju County Court (Harju Maakohus) in Tallinn, and either of us may ask any competent court for urgent interim measures. If you are a consumer, you keep the protection of the mandatory law of the country where you live, you may bring proceedings in the courts of the country where you live, and we may bring proceedings against you only there.

Changes. We may update these terms for a valid reason, such as a change in the law or in the services we offer. The version dated at the top applies from that date. A change never alters a signed agreement or work already ordered.

Privacy. How we handle personal data is explained in our Privacy Statement. It is information for you, not part of this contract.

If a clause fails. If a court finds any part of these terms invalid, the rest remains in force.

Language. If a translation of these terms, or of any other page on elevates.it, differs from the English text, the English text prevails, except that a consumer may rely on a translation where it is more favourable to them.

  4. Part D. Hosting and illegal content

What we do not host. When we host a website for you, you may not use it for illegal content, malicious code, or material that infringes the rights of others.

How we handle content. We do not monitor the websites we host. We act on notices and on what we otherwise learn, and we decide in a timely, diligent, non arbitrary and objective way. People make these decisions; we do not use automated tools for them.

Reporting illegal content. Anyone can tell us about content on a website we host that they believe is illegal. Write to [email protected] and include why you believe the content is illegal, the exact web address of the content, and a statement that you believe in good faith that the notice is accurate and complete. Add your name and email address so that we can confirm receipt and tell you our decision. You can also report without them.

What happens next. We confirm receipt, decide without undue delay, and tell you our decision and how you can challenge it: you can ask us to review it by replying to our message, and you can always take the matter to court. If we remove content or restrict access to it, we tell the client who provided it why, and offer the client the same two routes. If content suggests a threat to someone's life or safety, we inform the competent authorities.
